Settlement on Dominick Copinger 1628

  


To all Christian people to whom these presents shall come, John Copinger of the City of Cork, alderman, sendeth greeting in our Lord God Everlasting, Know ye that I, the said John Coppinger, for and in consideration of the conjugal affection and husbandlike love I bear towards Katherine Coppinger alias Katherine Roche my wife, in respect of her kind usage, and in respect of her virtuous, modest, and housewifely behaviour towards me and for and in consideration of the paternal affection and fatherly love I bear towards Dominick Coppinger, son to me the said John and Katherine Coppinger alias Roche my said wife, and for the natural desire I have to advance and prefer the said Katherine and Dominick Coppinger, have given, granted, enfeoffed, and confirmed, and by this my deed of feoffment indented I do give, grant, enfeoff, and confirm unto David Roche Fitz Richard of Kinsale, gent., and Dominick Roche Fitz Richard of the same, gent.,  All and singular the stone messuage, tenements and houses in the Parish of Christ Church within the said City of Cork, and the County of the said City, with all the edifices, taverns, shops, cellars, rooms, backside gardens, parcels, members, rents, and all other hereditaments and appurtenances thereunto belonging and appertaining, or that which was at any time heretofore lawfully and usually deemed reputed taken or known as part parcel or member thereof, as the said stone messuage, tenements, and houses, with all the edifices thereon and thereupon is and are situated, and lying and bounded in length from King's Street on the east to the walls of the said City of Cork aforesaid on the west, and in breadth from Edmond Martell's messuage on the south to John Gold Fitz Patrick's messuage on the north, and also the reversion and reversions, remainder and remainders of all and singular the premises, To have and to hold the said stone messuage, tenements, and houses, with all and singular the edifices, taverns, shops, cellars, backside gardens, rents, reversions, parcels, members, hereditaments, and all other the premises before expressed, with the appurtenances, unto the said David Roche and Dominick Roche, their heirs and assigns, and the survivor of them his heirs and assigns forever, to the only sole and proper use, behoof, and intention hereunder in this deed written, declared, expressed, meant, put down, and limited in all respects, to be holden of the chief lord of the fee by the rents and services of right due and accustomed, And I, the said John Coppinger, my heirs and assigns, all and singular the said stone messuage, tenements, and houses aforesaid, with all and singular the edifices, taverns, shops, cellars, backside garden, and all other hereditaments before expressed and mentioned, with the appurtenances unto the said David Roche and Dominick Roche, their heirs and assigns, and unto the survivor of them his heirs and assigns to the only sole uses, behoofs, and intents hereunder written as aforesaid against all manner of person or persons by these presents shall warrant and defend for ever.  And further know ye that the said John Coppinger with mine own proper hand have made livery and seizin, and delivered the quiet, peaceable, and actual seisin and possession of all and singular the said stone messuage, tenements, and houses, with all the edifices, taverns, shops, cellars, backside garden, and all other the premises before expressed, with the appurtenances, unto the said David Roche and Dominick Roche, to enure unto the said David and Dominick Roche, their heirs and assigns, to the only sole and proper uses, behoofs, and intentions hereunder written and expressed as aforesaid.  In Witness whereof I, the said John Coppinger, to this part of this my deed of feoffment indented remaining with the said David Roche and Dominick Roche, have put my seal and subscribed my name.  Dated the 18th day of July, Anno Dom. 1628, and the 17th year of the reign of our Sovereign Lord King James that now is King of England, France, and Ireland, and of Scotland the one and fiftieth.

The only intent, purport, and true meaning of the making and perfecting of the above deed of feoffment was and is at the time of making, sealing, and perfecting hereof and for ever hereafter, shall be in manner and form following, that is to say, that the said feoffees David Roche and Dominick Roche above mentioned and any of them, and the survivor of them his heirs and assigns for ever, shall stand and be actually seised of all and singular the said stone messuage, tenements, and houses, edifices, taverns, shops, cellars, backside garden, parcels, members, rents, hereditaments, and all other the premises, with the appurtenances contained in the above written deed, and every part and parcel thereof to the sole, proper, and only use, behoof, profit, and commodity of the said Katherine Coppinger alias Katherine Roche above mentioned, wife unto the said John Coppinger the feoffor, for and during her natural life, and after her decease then my will is and it is the intent, purpose, and true meaning of this deed that the said feoffees and every one of them, and the survivor of them, his heirs and assigns, shall stand and be seised of all and singular the said stone messuage, tenements, and houses, edifices, taverns, shops, cellars, backside garden, parcels, members, rents, hereditaments, and all other the premises before expressed and mentioned, with the appurtenances and every part and parcel thereof to the sole, proper and only use, behoof, profit, and commodity of the said Dominick Coppinger, son to me the said John Coppinger the feoffor, for and during his natural life, and after his death to the sole, proper, and only use and behoof of the heirs male of the body of the said Dominick Coppinger lawfully begotten and to be begotten, and for want of such heirs male then the said feoffees and every of them and the survivor of them, his heirs and assigns, shall stand and be seised of all and singular the premises to the sole, proper, and only use and behoof of James Coppinger, son to me the said feoffor, for and during his life, and after his decease to the use and behoof of the heirs male of the body of the said James Coppinger lawfully begotten and to be begotten, and for lack of such heirs male then my will is and so is the true meaning, purport, and intent of this deed, and at the making and perfecting thereof was and is that the said feoffees and every of them and the survivors of them his heirs and assigns shall stand and be seised for ever of all and singular the said stone messuage, tenements, and houses, and all other the premises before expressed and contained in the above written deed of feoffment with the appurtenances, to the only, sole, and proper use and behoof of Thomas Coppinger, son to me the said John Coppinger the feoffor, for and during his natural life, and after his death to the use and behoof of the heirs male of the body of the said Thomas lawfully begotten and to be begotten, and for default of such issue male, then the said feoffees and every of them and the survivor of them his heirs and assigns, shall stand and be seised of all and singular the premises to the only use and behoof of the heirs male lawfully begotten and to be begotten by me the said John Coppinger the feoffor upon the body of the said Katherine Coppinger alias Katherine Roche, and to the use and behoof of the heirs male of the said heirs male lawfully begotten, and to be begotten, and for want of such heirs male of the bodies of me the said John the feoffor and the said Katherine lawfully begotten and to be begotten, then the said feoffees and the survivor of them, his heirs and assigns, shall stand and be seised of the premises and of every part and parcel thereof to the sole and proper use, behoof, and profit of the heirs male of the body of me the said John Coppinger the feoffor, lawfully begotten and to be begotten, and for default of such issue male then to the use and behoof of Robert Coppinger Fitz Dominick and the heirs male of his body lawfully begotten and to be begotten, and for want of such heirs male then the said feoffees and the survivor of them, their heirs and assigns, shall stand and be only seised of all the premises to the use and behoof of Walter Coppinger Fitz James of Cork, Esq., and the heirs male of his body lawfully begotten and to be begotten, and for lack of such heirs male then to the use and behoof of the rightful heirs of me the said John Coppinger the feoffor for ever.
